There can be no question of camouflage. The fact that IG Fitness Switzerland is the sponsor of the “Qualitop” label has always been made transparent. For example, every piece of paper says “Qualitop, by IG Fitness” and our written offer to customers emphasizes that IG Fitness Switzerland is the owner of the “Qualitop” quality brand. The Qualitop homepage also transparently explains who is behind Qualitop (see FAQ, question “Who is behind Qualitop?”). And anyway, what interest should IG Fitness Switzerland have in acting as an alleged troublemaker?
This statement is false. QualiCert AG is concealing the fact that it is no longer authorized to award the “Qualitop” label as of 1 January 2021. The corresponding certification contract (contract between IG Fitness and QualiCert AG) was already terminated in June 2020. Conclusion: QualiCert AG can no longer certify you under the “Qualitop” label from January 1, 2021.
This statement is incorrect. All you have to do is sign our offer form, in which you accept the conditions (which is a matter of course in business transactions).
This statement is doubly incorrect. Firstly, there is no general right of withdrawal. And secondly, Qualitop is contractually capable insofar as the Qualitop organization can enter into contracts in its field of activity for IG Fitness. If you would like IG Fitness Switzerland to specifically confirm this legal fact, we will be happy to send you an additional confirmation. QualiCert AG is attempting to induce you to breach the contract, which is unfair and possibly also punishable by law.
Most of the money goes to the certifiers, who do the main work. Only a small portion is earmarked for the Qualitop organization so that it can cover its general costs. IG Fitness is also organized as an association and as such is not profit-oriented. Our aim is to enable fitness providers to obtain certification at attractive conditions.
It is not the case that IG Fitness defines the criteria for the standard itself. Standards are developed by standardization committees with the involvement of industry representatives, both IG Fitness member companies and non-members
This assertion relates only to the company name and has nothing to do with the Qualitop standard, which is the subject of the present case. Today’s QualiCert AG was originally founded decades ago (1997) as an association with the name Qualitop. Since 2009, however, QualiCert AG is no longer authorized to use the Qualitop standard in any way. We therefore cannot see what QualiCert AG is actually trying to say with its formally not incorrect (but irrelevant) claim. It seems that two different things are simply being deliberately mixed up.
